We collect and use your personal data when you use the website and for the services offered on the website in compliance with the relevant data protection regulation, with particular regard to the Federal Data Protection Act, the German Telemedia Act and the DSGVO (German equivalent to GDPR).  Personal data includes information that allows you to be identified (for example your name, address, your telephone number and/or your email address).

This data protection declaration explains which data we collect and what we use it for. It also explains how and for what purpose this happens and what rights you are entitled to. We would like to point out that data transmission over the internet can always have unavoidable security vulnerabilities.

3. Data collection on our website

The collection of data takes place when you provide us with this data. This can, for example, be data that you enter on a contact form. Other data is automatically recorded by our systems when our website is accessed, in particular technical data (e.g. operating system, internet browser, time of the page view). In some cases, data is also collected in order to be able to guarantee a technically error-free provision of the website. Other data can be used to analyse your user behaviour. This is mainly carried out with cookies and so-called analysis programmes. The analysis of your surfing and user behaviour is regularly carried out anonymously so that it cannot be traced back to you. 4. Contact
4.1 Contact form on the website

With regard to enquiries received via the contact form, your entries on the contact form and the contact details you provided there will be stored by us for processing the enquiry and in the event of follow-up questions. The processing of the data entered on the contact form takes place exclusively on the basis of your consent in accordance with art. 6 para. 1 lit. a of the DSGVO. You can revoke this consent at any time. All you need to do is send us an email. The legality of the data processing operations carried out before the revocation remains unaffected by the revoction. The data you entered on the contact form will remain with us until you ask us to delete it, revoke your consent to storage or the purpose for the data storage no longer applies. Statutory retention periods and other mandatory statutory provisions remain unaffected.

 

4.2 Customer enquiries by email, telephone

If you contact us by email or telephone, your enquiry and all personal data resulting from it (name, enquiry) will be stored and processed by us for the purpose of handling your enquiry. The processing of this data takes place on the basis of art. 6 para. 1 lit. b of the DSGVO if your enquiry is related to the performance of a contract or is necessary to carry out pre-contractual measures. In all other cases, the processing is based on your consent in accordance with art. 6 para. 1 lit. a of the DSGVO and/or on legitimate interests in accordance with art. 6 para. 1 lit. f of the DSGVO, as we have a legitimate interest in effectively processing the enquiries sent to us. The data you send to us via contact enquiries will remain with us until you ask us to delete it, revoke your consent to storage or the purpose for the data storage no longer applies. Statutory retention periods and other mandatory statutory provisions remain unaffected.

 

5. SSL and TLS encryption

To protect the transmission of confidential content that you send to us as the website operator, our website uses an SSL or TLS encryption. If the SSL or TLS encryption is activated, the data that you transmit to us cannot be read by third parties. You can recognise an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://”. The lock symbol in your browser line also indicates this.

The use of the Facebook plugins is based on art. 6 para. 1 lit. f of the DSGVO due to a legitimate interest in the widest possibile visibility on social media. If you visit our website, a direct connection is establised between your browser and the Facebook server. Facebook receives the information that you have visited our site and assigns this information to your personal user account on Facebook. If you click the Facebook “like” button while you are logged into you Facebook account, you can link the content of our pages to your Facebook profile. This enables Facebook to assign your visit to our website to your user account.

Each time you visit one of our pages that contains XING functions, a connection to the XING servers is established. To the best of our knowledge, personal data is not stored. In particular, no IP addresses are saved, and no usage behaviour is evaluated.

On our website we can integrate the videos of the “Vimeo” platform from the provider Vimeo Inc., Attention: Legal Department, 555 West 18th Street New York, New York 10011, USA.

8. Google Analytics

This website uses functions of the web analysis service Google Analytics. The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. The storage of  Google Analytics cookies and the use of this analysis tool are based on art. 6 para. 1 lit. f of the DSGVO due to a legitimate interest in analysing user behaviour in order to optimise the web content and advertising.

Google Analytics uses cookies which are stored on your computer and which enable your use of the website to be analysed. The information generated by the cookie about your use of this wesbite is usually transferred to a Google server in the USA and stored there.

We use Google Analytics on our website with the addition of “_gat._anonymizeIp”.  Through this, within member states of the European Union and in other contracting states to the Agreement on the European Economic Area, your IP address will already be shortened by Google and thereby anonymised. Google will use this information to evaluate your use of our sites, to compile reports on website activity and to provide other services relating to website activity and internet usage. Google may also transfer this information to third parties if this is required by law or if third parties process this data on behalf of Google. According to its own information, Google will under no circumstances associate your IP address with other Google data.

This website uses the “demographic characteristics” function of Google Analytics. This allows reports to be created that contain statements about the gender, age and interests of vistors to the site. This data comes from interest-based advertising from Google as well as from visitor data from third-party providers, but cannot be assigned to a specific person. You can deactivate this function at any time via the display settings in your Google account or prohibit the collection of your data by Google Analytics.

You can prevent the storage of cookies by selecting the appropriate setting in your browser software. However, we would like to point out that in this case you may not be able to use all the functions of this website to their full extent. You can prevent Google Analytics from collecting your data by clicking on the following link: deactivate Google Analytics. This will set an opt-out cookie that will prevent your data from being recorded on future visits to this website.

Furthermore, Google offers a deactivation add-on for the most common bowsers, which gives you more control over which data is collected by Google about the website you have accessed. Data stored by Google at user and event level that is linked to cookies, user recognition (e.g. user ID) or advertising IDs (e.g. DoubleClick-Cookies, Android advertising ID) is anonymised after 14 months or deleted. 9. Google Tag Manager

This website uses Google Tag Manager. Google Tag Manager is a solution that enables marketers to manage website tags from a single interface. The tool itself, which implements the tags, is a cookie-less domain and does not collect any personal data. The tool triggers other tags, which in turn may collect data. Google Tag Manager does not access this data. If a deactivation is made at the domain or cookie level, this remains in effect for all tracking tags that are implemented with Google Tag Manager.

 

10. Google AdWords and Google Conversion Tracking

This website uses Google AdWords. AdWords is an online advertising programme from Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States (“Google”). The storage of “conversion cookies” and the use of this tool are based on art. 6 para. 1 lit. f of the DSGVO. The website operator has a legitimate interest in analysing user behaviour in order to optimise both its website and its advertising.

We use so-called conversion tracking as part of Google AdWords. If you click on an ad placed by Google, a conversion tracking cookie will be set. These cookies lose their validity after 30 days and are not used to personally identify users. If the user visits certain content on this website and the cookie has not yet expired, we and Google can see that the user clicked on the ad and was redirected to this page.

Every Google AdWords customer receives a different cookie. The cookies cannot be tracked via the websites of AdWords customers. The information obtained using the conversion cookie is used to generate conversion statistics for AdWords customers who have opted for conversion tracking. These customers find out the total number of users who clicked on their ad and were directed to a page with a conversion tacking tag. However, they do not receive any information with which users can be personally identified. If you do not want to participate in tracking, you can object to this use by deactivating the Google conversion tracking cookie in your internet browser under user settings. You will then not be included in the conversion tracking statistics.

11. Google Maps

This site uses the Google Maps service via API. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. The use of Google Maps is in the interest of an appealing presentation of our online services and in making it easy to find the places we have indicated on the website. This represents a legitimate interest within the meaning of art. 6 para. 1 lit. f of the DSGVO.

To use the functions of Google Maps, it is necessary to save your IP address. This information is usually transmitted to and stored by Google in the USA. The provider of this site has no influence on this data transfer.

12. Google reCAPTCHA

This site uses “Google reCAPTCHA” (hereinafter “reCAPTCHA”). The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”).

The purpose of reCAPTCHA is to check whether data is entered on our website (e.g. on a contact form) by a person or by an automated programme. To do this, reCAPTCHA analyses the behaviour of the website visitor based on various characteristics. The analysis begins automatically as soon as the visitor enters the website. For the analysis, reCAPTCHA evaluates various information (e.g. IP address, the length of time the visitor stays on the website and mouse movements made by the user). The data collected during the analysis is forwarded to Google.

The reCAPTCHA analyses run completely in the background. Website visitors are not informed that an analysis is taking place.

The data processing takes place on the basis of art. 6 para. 1 lit. f of the DSGVO.

13. Facebook Pixel

Our website uses the visitor action pixel from Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”) to measure conversion. In this way, the behaviour of visitors to the page can be tracked after they have been redirected to the provider’s website by clicking on a Facebook ad. This enables the effectiveness of the Facebook advertisements to be evaluated for statistical and market research purposes and the optimisation of future advertising measures

The data collected is anonymous for us as the operator of this website; we cannot draw any conclusions about the identity of the user. However, the data is stored and processed by Facebook so that a connection to the respective user profile is possible and Facebook can use the data for its own advertising purposes in accordance with the Facebook data usage guidelines. This enables Facebook to place advertisements on Facebook pages as well as outside Facebook. As the website operator, we cannot influence this use of the data.

14. Marketo

We use the Marketo tool on our website, a service provided by Marketo EMEA Ltd., Red Oak North, South County Business Park, Leopardstown, Dublin 18, Ireland (“Marketo”). With the help of Marketo, we collect statistical data about the use of our website and communication measures in order to optimise our website accordingly, as well as to carry out email marketing and sales activities. This processing is partly automated, with the aim of evaluating certain personal information (profiling). Marketo records your IP address and uses cookies to track and analyse the use of the website in order to provide information specifically tailored to the interests of the user. For this purpose, one or more cookies are stored on your computer, through which data is collected for marketing and optimisation purposes and stored and processed on the Marketo servers (located within the EU/EEA). The data collected can then be combined with the personal data you voluntarily provided on the website to create a profile. 15. Hotjar

We use Hotjar to better understand the needs of our users and to optimise the range of information and the experience on this website. With the help of Hotjar’s technology, we get a better understanding of the user experience of our users (e.g. how much time users spend on which pages, which links they click, what they like and what they don’t etc.) and this helps us to tailor our range of information based on the feedback of our users. Hotjar works with cookies and other technologies to collect data about the behaviour of our users and about their end devices, in particular the IP address of the device (only recorded and stored anonymously while you are using the website), screen size, device type (unique device identifiers), information about the browser used, location (country only) and preferred language for displaying our website. Hotjar stores this information on our behalf in a pseudonymised user profile. Hotjar is contractually prohibited from selling the data collected on our behalf.

16. Newsletter

On our website we offer you the option of subscribing to our newsletter. When you register for our newsletter, we use the data required for this, or separately provided by you, in order to regularly send you our email newsletter. The data is processed on the basis of your consent in accordance with art. 6 para. 1 sentence 1 lit. a of the DSGVO. You can unsubscribe from the newsletter at any time and for this you can either send us a message or use a link provided in the newsletter. After unsubscribing, we will delete your data stored for the purpose of sending the newsletter with future effect. This does not affect data that we have stored for other purposes (e.g. email addresses for the customer account area).

The newsletter is sent via the mailing service provider “MailChimp”, a newsletter mailing platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA. The delivery service provider is used on the basis of our legitimate interests in accordance with art. 6 para. 1 lit. f of the DSGVO and an order processing contract in accordance with art. 28 para. 3 sentence 1 of the DSGVO. The delivery service provider can use the recipient’s data in pseudonymous form, i.e. without assignment to a user, to optimise or improve their own services, e.g. to technically optimise the delivery and presentation of the newsletter or for statistical purposes. However, the delivery service provider does not use the data of our newsletter recipients to write to them itself or pass the data on to third parties.

 

17. Your rights
17.1 Right to information, blocking, deletion and correction

You have the right to receive information about the origin, recipient and purpose of your stored personal data free of charge at any time. You also have the right to request the correction, blocking or deletion (“right to be forgotten”) of this data, provided that your request does not conflict with a legal obligation to store data.

 

17.2 Right to restriction of processing

You also have the right to request that the processing of your personal data be restricted. The right to restriction of processing exists

  • if you doubt the accuracy of your personal data stored by us. In this event we need some time to investigate this. For the duration of the investigation you have the right to request that the processing of your personal data be restricted.
  • if the processing of your personal data occurs unlawfully. In this event, instead of deleting it, you can also request that data processing be restricted.
  • if you have an objection according to art. 21 para. 1 of the DSGVO. In this event, your interests and ours must weighed up. For the period before it is clear whose interests previal, you have the right to request that the processing of your personal data be restricted.
  • if we no longer need your personal data, but you need it to exercise, defend or assert legal claims. In this event, you have the right to request that the processing of your personal data be restricted instead of being deleted.

If you wish to restrict the processing of your personal data, this data may only be processed with your consent or for the exercise, assertion or defence of legal claims, apart from its storage. Processing to protect the rights of another natural or legal person or for reasons of an important public interest of the European Union or a member state is also only pemitted with your consent.

 

17.3 Right to data portability

You also have the legal right to have the data that we process automatically on the basis of your consent, or in fulfilment of a contract, handed over to you or to a third party in a structured, commonly used, machine-readable format. A direct transfer of the data to another responsible person on request will only take place if this is technically feasible.

 

17.4 Revocation of your consent to data processing

Not all data processing operations are permitted without your express consent; some are only possible with your express consent. You can also revoke your consent at any time by informing us of this informally via email. The legality of the data processing carried out before the revocation remains unaffected by the revocation.

  

17.5 Right to object

 If the data processing is based on art. 6 para. 1 lit. e (performed in the public interest) or lit. f (legitimate interests) of the DSGVO, you have the right to object at any time to the processing of your personal data for reasons that arise from your personal situation. If you object, we will no longer process your personal data concerned, unless we can prove compelling legitimate reasons for the processing that outweigh your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims (objection according to art. 21 para. 1 of the DSGVO).

 

18. Right to lodge a complaint with the relevant supervisory authority
